Terms of Service

1. Eligibility

You must be at least 18 years old to create an account and use mokup. By agreeing to these Terms, you confirm that you meet this requirement and that the information you provide during registration is accurate and complete.

2. Your Account

You are responsible for keeping your login credentials secure. You are also responsible for all activity that occurs under your account. Notify us immediately at hello@mokup.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to use mokup to:

• Upload content that infringes any copyright, trademark, or other intellectual property right.
• Generate or distribute content that is unlawful, defamatory, harassing, pornographic, or otherwise objectionable.
• Attempt to reverse-engineer, scrape, or otherwise extract data or models from the platform.
• Use automated bots or scripts to interact with the service without prior written consent.
• Resell, sublicense, or redistribute raw access to the platform or its API to third parties.

We reserve the right to remove content and suspend accounts that violate these rules, without prior notice.

4. AI Features and Third-Party APIs

Several features on mokup use artificial intelligence, including AI design generation, AI product photography (Pro Shot), the AI Studio, and background removal. These features are powered in part by third-party AI providers (such as OpenAI, Stability AI, or similar services). By using these features, you acknowledge and agree to the following:

• Content transmission: Content you upload or input (including images, text prompts, and design files) may be sent to third-party AI providers to fulfill your request.
• No training on your data: We contractually require that third-party providers do not use your content to train their models. However, you acknowledge that their own terms of service also apply.
• Output accuracy: AI-generated outputs are produced algorithmically. We do not guarantee accuracy, suitability, or fitness for any particular purpose. Review all AI outputs before commercial use.
• Your responsibility: You are solely responsible for ensuring that content you upload and outputs you use comply with applicable laws, third-party rights, and platform rules.
• Prohibited AI inputs: Do not submit prompts or upload content designed to generate harmful, deceptive, or illegal outputs. We may filter, block, or report such activity.

5. Credits and Subscriptions

Certain features, particularly AI generation and Pro Shot, consume credits. Credits are allocated based on your subscription plan. The following applies to all purchases:

• Subscription fees are billed in advance on a monthly or annual cycle.
• Credits do not roll over between billing periods unless your plan explicitly states otherwise.
• All fees are non-refundable except where required by applicable law or at our sole discretion.
• We may change plan pricing with at least 30 days notice to your registered email address.
• Free plan users are subject to usage limits and may have access to fewer features or lower-resolution exports.

6. Intellectual Property

Your content: You retain all ownership rights to artwork, designs, and files you upload. By uploading content, you grant us a limited, non-exclusive license to process and store it solely for the purpose of providing the service to you.

Your outputs: Mockup renders, AI-generated images, and exported files you produce using your own content are yours to use commercially, subject to any restrictions in the applicable third-party AI provider terms.

Our platform: mokup's software, UI, 3D models, template designs, and branding are owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, or redistribute them.

7. Templates and 3D Models

Templates and 3D models provided by mokup are licensed for use within the platform. You may use outputs created from these models commercially. You may not extract, export, or redistribute the raw 3D model files or template source files outside of the platform.

8. Third-Party Services and Links

mokup may link to or integrate with third-party tools and services. We are not responsible for the content, privacy practices, or reliability of any third-party service. Your use of those services is governed by their own terms.

9. Disclaimers

mokup is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or free of viruses. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, mokup and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim will not exceed the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold harmless mokup and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the service, your uploaded content, or your violation of these Terms.

12. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account at any time for violation of these Terms. On termination, your right to access the service ceases immediately. We are not obligated to retain your data after termination, though we will follow our Privacy Policy regarding data deletion requests.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, notify you by email. Continued use of mokup after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which mokup operates, without regard to conflict of law principles. Any disputes will be resolved in the courts of that jurisdiction, and you consent to personal jurisdiction there.
